Terms of use

AskJolene.com ("AskJolene") is provided to you by AJ Beheer B.V. ("AJBeheer"). By using AskJolene you agree to be bound by the following terms and conditions ("Terms of Use"). If you do not agree with these Terms of Use, please do not use AskJolene.

Your use of AskJolene

AskJolene is provided only for your personal use. You must be at least 18 years old to use AskJolene. You may not make any commercial use of AskJolene. You may not use AskJolene to sell a product or service, or to increase traffic to your Web site for commercial reasons, such as advertising sales. You may not send automated queries to AskJolene without AJBeheer's prior agreement.

If you wish to make commercial use of AskJolene, i.e. take the results from an AskJolene search and reformat and display them, or mirror the AskJolene home page or results pages on your Web site, or send automated queries to AskJolene you must first enter into a commercial agreement with AJBeheer, otherwise you may not do so.

We encourage people to add a AskJolene search box to their web sites.

Content Linked to by AskJolene

The sites displayed as search results or linked to by AskJolene are developed by people over whom AJBeheer exercises no control. The search results that appear on AskJolene are generated by AJBeheer's automated processes, and AJBeheer cannot and does not screen the search results before they are included in the indices from which search results are generated.

Some searches using AskJolene may produce results and links to sites that some people find objectionable, inappropriate, or offensive. AJBeheer cannot guarantee that a search on AskJolene will not locate unintended or objectionable content and AJBeheer assumes no responsibility for the content of any site included in any search results or otherwise linked to by AskJolene.

If you find images on AskJolene that might be deemed universally objectionable, or if you don't want your galleries or pictures to appear on AskJolene, send us the URL of the page, date, the query leading to the gallery, and the number of the result.

Child protection

AJBeheer does not condone child pornography. If you find galleries or pictures of this nature linked by AskJolene, please contact the administrator on webmaster@askjolene.com. AskJolene fully supports the Association of Sites Advocating Child Protection, www.asacp.org, and we encourage the reporting of child pornography to this non-profit organisation.

AskJolene also implements ICRA and the RTA labels to help protect minors from viewing unwanted content.

 

Copyright Infringement

AJBeheer reserves the right to remove content from AskJolene that appears to infringe the copyright or other intellectual property rights of others. In addition, AJBeheer may permanently remove from its index hosts that appear to infringe the copyright or other intellectual property rights of others.

If you believe that your copyright in any material has been infringed on the AskJolene website, please notify us for Notice of Claims of copyright infringement who can be reached at: copyright@askjolene.com.

You must provide our agent with the following information, Identify the copyrighted work that you claim has been infringed;

  • Identify the material on our site that you claim is infringing, with enough detail so that we may locate it on the site;
  • Your name, address, telephone number, and e-mail address;
  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  • A statement by you declaring under penalty of perjury that (a) the above information in your Notice is accurate, and (b) that you are the owner of the copyright interest involved or that you are authorized to act on behalf of that owner;
  • Your physical or electronic signature.

Additionally, AskJolene provides erotic information, erotic stories, thumbnails and descriptions of all galleries retrieved from the internet and user generated content. Before reporting any files to us for deletion, you should have taken notice of the above information.

Disclaimer of Warranties

You accept that AJBeheer provides AskJolene "as is" with all faults and without any warranties or conditions of any kind, express or implied. To the fullest extent permissible pursuant to applicable law, AJBeheer disclaims all warranties, express or implied, including without limitation warranties of merchantability, fitness for purpose or non-infringement of third party and proprietary rights.

AJBeheer makes no warranties or representations in relation to (i) results that may be obtained from using AskJolene, (ii) any products, services, information, or other material purchased or obtained by you through AskJolene or any advertisements on AskJolene.

You download or otherwise obtain any material through the use of AskJolene at your own risk and you are solely responsible for any damage that may occur to your computer system or loss of data that may result.

Limitation of Liability

Under no circumstances shall AJBeheer be liable to you for direct, indirect, special or consequential damages (including lost profits) of the other, even if such party has been advised of the possibility of such damages under or in connection with these terms of use or resulting from: (i) the use or inability to use AskJolene; (ii) any information, goods or services obtained through search results or advertisements on AskJolene; (iii) any third parties material or content accessed as a result of using AskJolene; or (iv) any other matter relating to AskJolene.

No action, regardless of form, arising out of the use of AskJolene or under these Terms of Use may be brought by you more than one year after the event which gave rise to the cause of action occurred.

Without limiting the foregoing, under no circumstances shall AJBeheer be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, sexual disorders, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

Miscellaneous Provisions

These Terms of Use will be governed by and construed in accordance with the laws of The Netherlands, without giving effect to its conflict of laws provisions or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Use to be unenforceable, the remainder of the Terms of Service will continue in full force and effect.

These Terms of Use constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by AJBeheer.
